New Vision® has just released two press releases regarding our best-selling Essential VitaminsT Plus Mangosteen. The first press release updates you on the status of our lawsuit with XangoT. The second press release contains exciting news about the long-term supply contract with the finest mangosteen raw material available in the world.
My father used to tell me, "Paper never refuses ink. You can write anything, but it doesn't mean it's true." That's the first thought that came into my mind when I read the XanGo recent press release (July 23rd, 2004). XanGo now claims their patent covers our new formulation.
The two law firms engaged in this dispute are both respected and large. A nationally-recognized patent attorney issued an expert opinion letter to us that states, "the New Vision formula does not infringe the claims of the (XanGo) patent literally or under the Doctrine of Equivalents." Anticipating that XanGo would make this claim, we have asked the court to issue a ruling that our new formulation does not infringe on their patent (assuming that it is enforceable). Any businessperson can read the patent and see infringement requires ALL THREE of the following:

The product must include mangosteen.

The product must include pericarp.
- The product must include the juice of a fruit or vegetable.
The new and improved version of New Vision's Essential Vitamins Plus Mangosteen does NOT contain all three. The patent we've applied for and expect to have approved within 12 to 16 months covers mangosteen, pericarp, aloe and green tea.
I am also excited to announce we have entered into a long-term supply contract for mangosteen with the finest raw material supplier in the world. Yibing Wang, MD, PhD, New Vision Director of Research, tested what seemed like the world's entire supply of mangosteen raw material and it amazed me how many sources couldn't pass our potency standards and quality control.
After independently testing samples from all over Southeast Asia, the BEST source of garcinia mangostana, on the basis of quality and potency, was secured this week. This source will remain a closely-guarded secret. In addition, we have been guaranteed the necessary supply of whole fruit mangosteen to meet the growing demand for our Essential Vitamins Plus Mangosteen.
Another piece of misinformation needing clarification concerns the composition of our product. We use the whole fruit of the mangosteen including the pericarp. Furthermore, every xanthone that is naturally found in the mangosteen fruit is in our product and I challenge any company to prove their product contains more xanthones of any kind than our Essential Vitamins Plus Mangosteen.
Companies can send out all the press releases they want, but it still won't change the facts. Our task is telling the world about the wonders of mangosteen. The public is counting on both companies to do just that. The market is big enough for ALL who want to compete and in the end, the customer wins.
